Terms of Service
Effective date: June 1, 2026
1. Agreement
These Terms of Service ("Terms") form a binding agreement between you and SOS Fitness Services & Equipment, part of The SOS Group ("SOS Fitness", "we", "us", "our"), with offices at 6025 4 St SE, Calgary, AB T2H 2A5, Canada. By accessing thesosgroup.ca ("Site") or purchasing repair, maintenance, inspection or equipment-sales services ("Services"), you agree to these Terms.
2. Use of the Site
You may use the Site for lawful, personal or internal business purposes. You agree not to: (a) interfere with or disrupt the Site or its security; (b) attempt to gain unauthorized access to any portion of the Site or related systems; (c) use any automated means to scrape or copy content other than ordinary search-engine indexing; or (d) use the Site to violate any applicable law or third-party right.
3. Quotes, bookings and orders
Quotes provided through the Site, by email or by phone are estimates based on the information you provide and are valid for 30 days unless stated otherwise. Final pricing may vary based on on-site assessment, parts availability, freight, taxes and additional work authorized by you. A booking or order is confirmed only once we acknowledge it in writing (including by email).
4. Service work
- You authorize SOS Fitness and its technicians to access the service location and to perform the work described in the accepted quote or work order.
- You represent that you own the equipment or have the right to authorize work on it.
- We will use commercially reasonable efforts to complete work on schedule, but timelines are estimates and depend on parts availability, manufacturer support and site conditions.
- Additional work outside the scope of the original quote requires your prior approval and may be invoiced separately.
5. Payment
Unless otherwise agreed in writing, invoices are due on receipt. Overdue amounts may bear interest at 1.5% per month (19.56% per annum) and you are responsible for reasonable collection costs and legal fees. All prices are in Canadian dollars and exclusive of applicable taxes (including GST), which will be added where required.
6. Equipment sales
Title to equipment passes to you on full payment. Risk of loss passes on delivery to your service address (or to the carrier where you arrange shipping). New equipment is covered by the applicable manufacturer warranty. Refurbished and used equipment is covered by the specific warranty stated on the invoice or product page; outside that warranty, equipment is sold on an "as-is" basis to the maximum extent permitted by law.
7. Workmanship warranty
We warrant our workmanship for 30 days from the date of service on the specific issue addressed, provided the equipment has not been further serviced, modified or misused by a third party. Parts are covered by the manufacturer's warranty, which we will pass through to you. This warranty is in lieu of all other warranties to the maximum extent permitted by applicable consumer-protection law.
8. Cancellations and missed appointments
You may cancel or reschedule a service appointment without charge with at least 24 hours' notice. Cancellations with less notice, missed appointments or denied access may be subject to a trip-charge fee. Deposits on special-order parts are non-refundable once the order has been placed with the supplier.
9. Customer responsibilities and safety
- Keep equipment unplugged or otherwise safe to inspect until our technician authorizes operation.
- Provide accurate information about the equipment, prior service and any known hazards on site.
- Ensure a safe working environment, including adequate space, lighting and access.
- Discontinue use of any equipment we identify as unsafe until repaired or decommissioned.
10. Limitation of liability
To the maximum extent permitted by law, SOS Fitness's total liability for any claim arising out of or relating to the Site or the Services is limited to the amount you paid us for the specific Service giving rise to the claim in the 12 months preceding the event. We are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of revenue, profits, data, goodwill or business interruption, even if advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be limited under applicable law (including for gross negligence, willful misconduct, or under Alberta and federal consumer-protection legislation).
11. Indemnity
You agree to indemnify and hold harmless SOS Fitness and its officers, employees and contractors from any third-party claims, losses, damages and expenses (including reasonable legal fees) arising from (a) your breach of these Terms, (b) your misuse of the Site or Services, or (c) equipment use by you or your invitees after a service visit, except to the extent caused by our negligence or willful misconduct.
12. Intellectual property
The Site and its content (text, graphics, logos, photos, code) are owned by SOS Fitness or its licensors and protected by Canadian and international intellectual- property laws. Brand names such as Life Fitness, Precor, StairMaster, Nautilus, Schwinn, Keiser, Throwdown and GymRax are trademarks of their respective owners and are used here for identification and authorized-dealer purposes only.
13. Third-party links
The Site may contain links to third-party websites. We do not control and are not responsible for the content, policies or practices of those sites.
14. Privacy
Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
15. Governing law
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable there. The courts located in Calgary, Alberta have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services, subject to any non-waivable consumer-protection rights you may have in your jurisdiction of residence.
16. Changes
We may update these Terms from time to time. Updates take effect when posted to the Site with a revised "Effective date". Your continued use of the Site or Services after that date constitutes acceptance of the updated Terms.
